The Collapse of the 28-Clause Peace Proposal for Ukraine: How Peace Negotiations Continue to Falter

Europe breathed a deep collective sigh of relief on Monday, as the tension caused by the presentation of a new 28-article proposal for achieving ceasefire appeared – momentarily – to have been contained. A American diplomat spoke of "notable headway" after Ukraine-US talks in Geneva. On Monday night, the Kremlin made its retaliation: a renewed assault of aerial bombardment on Kyiv.

The Cycle of Negotiation and Warfare

The succession of opposing developments captured the grim essence of the current period. By day, negotiation efforts are fought: optimistic declarations are issued from multiple capitals. Immense energy is expended on containing particular approaches. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the primary tool for achieving "peace".

Nocturnal Warfare

As the offensive progressed into the early hours of Tuesday, the current condition of Ukraine's exposure was revealed. Ukraine is able to track missile launches from Russian territory, a capability enabled by current data. From observation points, military aircraft that had been dispatched to engage hostile guided weapons streaked across the sky – modern combat jets delivered to Ukraine by Western partners.

Moments later, Kyiv's missile defense activated: several firings fired to intercept a incoming threat. This was a sophisticated defense system at work, most likely delivered by allied countries. Every firing shakes the surroundings, shaking the windows. The moment of terror quickly transforms into sober acceptance: maybe the incoming missile won't hit its mark this time, preventing destruction from catastrophe and another blackout.

Persistent Threats

Following this, a heavy machine gun engaged a drone close by, part of a defensive team – most likely Western-made equipment. Sadly, the bullets missed the opposing UAV – it pressed on overhead toward its destination.

Periodically, this persisted until dawn. Kyiv faced the early updates: multiple fatalities, damage and heating outages in numerous residences as a result of the nocturnal offensive. As typically, everyone still continued their routines – enduring hostilities. But those full day illustrated Ukraine's essential dependence on external assistance – a dependence that European nations are demonstrably unable to fill in the near term.

Failed Diplomacy

The 28-point plan from Washington provoked deep reactions, debate and deep concern – and briefly redirected concern from Ukraine's largest corruption scandal in years. Yet, we have witnessed similar scenarios, after earlier high-level meetings and multilateral gatherings.

Every new approach from Washington follows the identical sequence: a political offensive against Ukraine, which Kyiv, with other European capitals, manages to fend off. They stabilise the situation but never actually secure success. This pattern will, no doubt, continue.

Political Considerations

It is easy to blame certain parties of consistently pushing Kremlin's demands. But that does not seem to be the complete picture. American leadership functions according to a assumption well known to experienced diplomats: you cannot secure via talks what you have lost on the battlefield. The American government assumes that it is impossible to compel Moscow to surrender the territory that it already controls in Ukraine's southern or eastern regions.

The challenge is that while recognising this factual reality, American administration does nothing to discourage Russia, through words or deeds, from believing that the situation will not shift further in its advantage in the months ahead.

Opposing Positions

Therefore, Russian leadership is convinced that time is on his side – that Ukraine and its partners are coming close to fatigue. Their reason to accept conditions that does not give them the largest achievable advantage is close to zero. There may be multiple initiatives to end hostilities, but they will carry on as long as Russia's government remains supremely confident in the outcome.

On the contrary, Kyiv believes that Ukraine can still persist, gradually sacrificing lives and land but averting a complete military breakdown until conditions improve in its advantage.

Existing Situation

Realistically, there are no real preconditions for a truce. Now, individual motivations are entering the equation: leadership ambitions to mediate resolution and obtain worldwide acknowledgment, and Ukrainian leadership's twin challenges – on one hand, not to alienate a key ally, and on the other, to unite the population around the country's interests against any proposal Kyiv finds unworkable, so that their priority does not move to internal issues. And although their task will now be significantly challenging after recent developments, it remains very improbable that this will change their overall approach.

These two forces are guiding negotiations.

Assessment and Future

It took a just a single week to kill the suggested clauses of the current initiative. Forceful and unpredictable management of the matter by Washington, pushback by Ukraine and the other European countries, along with calming attempts of negotiators, and finally, recent disclosures, all achieved their purpose.

While new plans based on old ideas are forthcoming, Kyiv, London and other Western governments should reach an essential realization: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are rooted in Kremlin requirements and demonstrate specific hesitation to modify developments, if they remain united and improve their protective measures at a significantly accelerated rate. If they do, neither external pressure nor military threats will be able to overcome them. In the meantime, Ukraine's capability to counter nocturnal attacks will, for the predictable period, largely rely on ongoing international assistance.
